Terms and Conditions for Mobile Bar Services Contract Workers

1. Introduction

These Terms and Conditions set forth the terms and conditions under which the Contract Worker agrees to provide mobile bar services for Tasty Libations Mobile Bar Service. By signing this Agreement, the Worker acknowledges and agrees to abide by all provisions outlined herein.

2. Scope of Services

The Worker agrees to provide bar services at events as requested by the Company, which may include:

  • Setting up and dismantling the mobile bar

  • Serving alcoholic and non-alcoholic beverages

  • Providing excellent customer service

  • Ensuring all relevant safety standards are met

  • Ensuring compliance with all local laws and regulations regarding alcohol service

The specific services required will be outlined in the individual job order or contract for each event.

3. Payment and Compensation

  • The Worker will be compensated at the rate agreed upon in the individual job order.

  • Payment will be made after the completion of the event and upon submission of an invoice (if applicable).

  • Any tips, gratuities, or additional payments made by customers directly to the Worker are the Worker’s property.

4. Independent Contractor Status

The Worker acknowledges and agrees that they are an independent contractor and not an employee of the Company. The Worker is solely responsible for any tax obligations and will receive no benefits (e.g., health insurance, retirement) provided by the Company.

5. Work Hours and Schedule

  • The Worker is expected to adhere to the event schedule as provided by the Company.

  • The Company is not liable for delays or cancellations caused by the Worker’s failure to arrive on time.

  • Workers may be required to work flexible hours, including evenings, weekends, and holidays, depending on the event.

6. Dress Code

The Worker agrees to wear attire as specified by the Company. This may include branded shirts, uniforms, aprons, or other clothing required for the event.

7. Equipment and Supplies

  • The Company will provide necessary bar equipment, including the mobile bar setup, glassware, and utensils unless otherwise agreed.

  • The Worker is responsible for ensuring that all provided equipment is used properly and returned in good condition. Any loss or damage to equipment may result in deductions from payment to cover repair or replacement costs.

8. Alcohol Service & Legal Compliance

  • The Worker is responsible for adhering to all local, state, and federal laws related to alcohol service, including verifying the age of customers and refusing service to intoxicated individuals.

  • The Worker must have the necessary certifications (e.g., TIPS, Responsible Beverage Service Training) as required by law and provide proof of certification if requested by the Company.

9. Confidentiality

The Worker agrees to keep any confidential information, including event details, customer lists, and proprietary business practices, strictly confidential and not disclose such information to any third party without prior written consent from the Company.

10. Health and Safety

The Worker must adhere to all health and safety protocols during events, including but not limited to:

  • Maintaining cleanliness and hygiene at the bar

  • Wearing necessary safety equipment (if provided)

  • Ensuring that no one consumes alcohol inappropriately or excessively

  • Reporting any safety concerns to the Company or event organizers immediately

11. Liability and Indemnity

  • The Worker agrees to indemnify and hold harmless the Company from any claims, damages, liabilities, or expenses arising out of the Worker’s actions, negligence, or breach of this Agreement.

  • The Worker is responsible for ensuring their actions comply with all relevant laws, including alcohol consumption laws and health and safety regulations.

12. Termination of Agreement

This Agreement may be terminated by either party for any reason, with or without cause, with written notice provided to the other party. Upon termination, the Worker must return any Company property and complete any outstanding work (e.g., finishing service for the event).

13. Dispute Resolution

Any disputes arising out of or related to this Agreement will be resolved through mediation or, if necessary, binding arbitration. The venue for any arbitration will be San Antonio, Texas.

14. Amendments

This Agreement may be amended only by a written document signed by both parties.

15. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state of Texas, without regard to its conflict of law principles.
